Agreement to Terms

By downloading, installing, or using Mindrise ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

Description of Service

Mindrise is a personal wellness application that provides:

• AI-generated daily affirmations
• Themed written narratives
• Journaling features (text, voice, and handwritten)
• AI-generated imagery
• Streak and progress tracking

Account Registration

• You must provide a valid email address to create an account
• You are responsible for maintaining the security of your account
• You must be at least 13 years old to use this App
• One account per person; accounts are non-transferable

Subscription and Payments

Free Tier

• Daily AI-generated affirmations
• Text journaling

Pro Subscription

• All Free features
• AI-generated images
• Guided narratives
• Voice and handwritten journaling
• Custom instructions

Premium Subscription

• All Pro features
• Personalized AI images with your reference photo
• Journal-based personalization
• Premium art styles

Billing Terms

• Subscriptions are billed through Apple App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You can manage and cancel subscriptions in your App Store account settings
• No refunds for partial subscription periods

User Content

Your Content

• You retain ownership of content you create (journal entries, photos)
• By using the App, you grant us a license to process your content for providing the service (e.g., AI analysis for personalization)
• We do not claim ownership of your personal content

Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Upload harmful, offensive, or inappropriate content
• Attempt to reverse engineer or hack the App
• Share your account with others
• Use the App to harm yourself or others

AI-Generated Content

• Affirmations, narratives, and images are generated by AI
• AI content is provided for personal wellness purposes only
• AI content is not a substitute for professional mental health care
• We do not guarantee the accuracy or appropriateness of AI-generated content

Mental Health Disclaimer

Intellectual Property

• The App, its design, features, and branding are owned by us
• You may not copy, modify, or distribute the App without permission
• "Mindrise" and associated logos are our trademarks

Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the App in the past 12 months
• We are not responsible for any harm resulting from your use of the App

Termination

• You may delete your account at any time through Settings > Delete Account
• We may terminate or suspend your account for violation of these terms
• Upon termination, your data will be permanently deleted

Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new terms. We will notify you of significant changes.

Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in accordance with applicable law.

Apple App Store Terms

The following terms apply to your use of Mindrise when downloaded from the Apple App Store:

• Acknowledgement: These Terms of Service are between you and BW96 Studios LLC ("Developer"), not Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for Mindrise and its content.
• Scope of License: The license granted to you is limited to a non-transferable license to use Mindrise on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Maintenance and Support: The Developer is solely responsible for providing maintenance and support services for Mindrise. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to Mindrise.
• Warranty: The Developer is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of Mindrise to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Mindrise.
• Product Claims: The Developer, not Apple, is responsible for addressing any claims relating to Mindrise or your use of it, including: (a) product liability claims; (b) any claim that Mindrise fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
• Intellectual Property: In the event of any third-party claim that Mindrise or your possession and use of Mindrise infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
